If You Disagree with What State Inspectors Do, Go to the State Regulatory Service

On 30 November, the Law of Ukraine “On Amending Some Legislative Acts of Ukraine Regarding Improvement of Laws on State Supervision (Control)” took full force.

As per the newly enacted changes, the State Regulatory Service of Ukraine is allowed to draw up administrative offence reports with regard to public officials in breach of laws on state supervision (control), licensing, and regulatory approval system in the field of economic activity.

Previously, these powers were vested in the Ministry of Economic Development and Trade of Ukraine and the State Regulatory Service of Ukraine.

Besides, the new law introduces administrative liability for the failure to enter or for entering inaccurate data or incomplete data on state supervision (control) measures in the integrated automated system of state supervision (control).

In view of the free access available to the system’s data, an additional mechanism has appeared for exercising open control over activities of state supervision bodies, including by business entities and NGOs.

On the same day, 3 November, alongside the above law, the Verkhovna Rada of Ukraine also passed two more laws – regarding the moratorium on inspections and regarding the liberalization of state supervision system – both pending to be signed by the President.
