Building Conditions Simplified for Construction Companies

On 15 April 2016, a resolution of the Cabinet of Ministers of Ukraine No. 256 dd. 30.03.2016 will be published by the OfitsiynyiVisnykUkrayiny (Official Gazette of Ukraine) and come into full force, to approve the Licensing Rules and the List of Business Works for Construction of Facilities with Complexity Levels IV and V. As reported on the official website of the Cabinet of Ministers of Ukraine (http://www.kmu.gov.ua/control/ru/cardnpd?docid=248941066) , in comparison to the previously effective licensing terms (order of the Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine No. 47 of 27 January 2009),the above regulationhas more than twice reduced the number of construction works subject to licensing.Specifically, the following works have been removed from the list:

  • designing works, as today their performers have to go through attestation and certification procedures;
  • construction works with regard to facilitates of complexity levels І-ІІІ;
  • ngineering works, as performers of some extent of these works have to receive certificates. Any overlapping of works has been eliminated in the new list.

Generally, according to the Government, the new Licensing Rules and the List of Construction Works materially simplify doing business for design agencies, construction organisations dealing with projects of low complexity levels, and for engineering and consultancy services providers. This will further facilitate creating simple and clear conditions of working in the construction market of Ukraine. In addition, the Cabinet of Ministers of Ukraine, by approving the new Licensing Rules and the List of Construction Works, has brought them into compliance with the Law of Ukraine No. 222 VIII dd. 02.03.2015 “On Licensing Certain Types of Economic Activity” enacted on 28 June 2015.
