As secured by Article 59 of the Constitution of Ukraine, everyone shall have the right to legal assistance. Everyone shall be free to choose the defender of his or her rights.

Part 2 Art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms stipulates that everyone charged with a criminal offence shall be presumed innocent until proved guilty according to law.

In the light of the country’s course toward the European standards which are marked by recognition of the human rights value and encouragement of their protection, nowadays it is important to be aware of any changes in the national legislation adjusted to ratified conventions and adopted resolutions of the European Court of Human Rights.
